Terms and Conditions

Retainers, Payments, and Taxes 1. The date of the order is considered “booked” upon receipt of a non-refundable retainer equaling 50% of the total value of the order and a signed Order Form. 2. Work on the order will not start until the order is considered “booked”. 3. The final payment is due on customer receiving completed order. 4. If the Client fails to provide the Final Payment in full on the Need By Date, Sweet as Southern Tea retains the right to cancel the order with no goods transferred to the customer and no refund given. 5. Sweet as Southern Tea does not accept personal checks as a form of payment. Liability 1. Sweet as Southern Tea is not responsible for bodily injury or property or consequential damage which may result from services. 2. Sweet as Southern Tea is not responsible for any damage to the order or any other issues with the order caused by anyone NOT employed by Sweet as Southern Tea. 3. Sweet as Southern Tea is not responsible for any issues with or damage to an order once the order has been transferred to the customer. Fulfillment of Order 1. Sweet as Southern Tea is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, delay in supplies, or any other circumstance beyond Sweet as Southern Tea’s control. 2. If Sweet as Southern Tea has completed the order but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 100% of the total cost minus the cost of materials purchased for the order. 3. If Client picks up the order, Sweet as Southern Tea no longer assumes any responsibility for damage caused to it. Postponement/Cancellation 1. The Client must notify Sweet as Southern Tea if there is a change in the Need By Date of the order or a complete cancellation. 2. If the postponement occurs before 4 days of the Need By Date no penalty fee will be charged. 3. If the postponement occurs after 4 days prior to the Need By Date, the Client will be charged a fee of 10% of the total cost of the order. 4. Sweet as Southern Tea reserves the right to increase this fee to a maximum of 20% of the total cost of the order depending on the type and complexity of the order. 5. If the customer cancels the order, the retainer fee is non-refundable. Changes to Order 1. Any changes must be submitted 6 days in advance. 2. There will be no changes allowed 3 days prior to the Need By Date. Design of the Order 1. Sweet as Southern Tea will follow the Client’s requests closely to create the order as described. 2. Sweet as Southern Tea will not duplicate an exact copy of another’s work but will ensure the design is similar in order to achieve the desired look. Serving Amount and Sizes 1. Our calculated serving size for a slice of cake is 2 inches wide x 2 inches long and is usually two layers tall. 2. Serving size estimations are not guaranteed to be exact. 3. Sweet as Southern Tea is not responsible for a shortage of cake if the pieces are cut too large. Allergy & Dietary Warnings 1. Sweet as Southern Tea operates under the cottage food law of Alabama and therefore baked goods may have come in contact with allergen ingredients. 2. The Client is responsible for pointing out potential allergy hazards. Delivery and Set Up 1. There is a delivery fee of 5% of the total cost of the order or $10, whichever is higher. 2. The Client may pick up the order. The Client assumes liability once it passes into the Client’s possession. 3. The Client is responsible for providing a suitable environment for the order (away from heaters, vibrations, people, suitable surface, suitable outdoor setting). 4. By providing the Final Payment amount to Sweet as Southern Tea, The Client agrees that the condition of the order is satisfactory. 5. Once the Final Payment is received, Sweet as Southern Tea is not responsible for the condition of the order including collapse, melting, pokes, etc. Photographs 1. Sweet as Southern Tea reserves the right to use photographs of the order for advertising purposes. Your order is very important to us.
